Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and BigTruckPage LLC ("BigTruckPage," "BTP," "we," "us," or "our") governing your access to and use of BigTruckPage.com and related services. By creating an account, listing items, purchasing, messaging other users, or otherwise using the marketplace, you agree to these Terms and our Privacy Policy.

We may update these Terms from time to time. When we do, we will post the revised Terms on this page and update the "Last updated" date. Your continued use of the site after changes are posted constitutes acceptance of the updated Terms.

BigTruckPage operates an online marketplace that connects buyers and sellers of heavy-duty truck parts, complete trucks, trailers, and freight or hauling services. Our platform provides listing tools, search, messaging, payment connectivity through Stripe, and optional integrations such as eBay export for eligible sellers.

BTP is not a party to transactions between buyers and sellers, except when we sell our own inventory as a direct seller. BigTruckPage only helps list and connect buyers and sellers. We do not hold funds and are not responsible for the item, the transaction, or the payment processor.

You must be at least 18 years old and capable of entering a binding contract to use BigTruckPage. The marketplace is intended for users located in the United States. By registering, you represent that the information you provide is accurate, current, and complete, and that you will keep your account information up to date.

Accounts are authenticated through Firebase Authentication, including email and password sign-in and Google sign-in where enabled. Sellers may invite team members with role-based access, including Finance + listings permissions or listings-only access, subject to the permissions assigned by the account owner.

You are responsible for safeguarding your login credentials and for all activity that occurs under your account or team access. Notify us promptly if you suspect unauthorized access. We may suspend or permanently ban accounts that violate these Terms, applicable law, or marketplace policies, including for fraud, abuse, or repeated policy violations.

Sellers are solely responsible for the accuracy, legality, condition, pricing, and fulfillment of every listing. Listings must comply with applicable federal, state, and local laws, including DOT and EPA requirements where relevant. Prohibited listings include stolen parts or equipment, salvage or rebuilt items without proper disclosure, safety-recall parts sold without disclosure, and any items that misrepresent origin, condition, or compatibility.

To accept card payments from buyers, sellers must connect a Stripe account through Stripe Connect Express onboarding or Stripe Connect Standard OAuth, complete identity and payout verification as required by Stripe, and maintain an account in good standing.

You retain ownership of photos, descriptions, and other content you submit. By posting a listing, you grant BigTruckPage a non-exclusive, worldwide license to host, display, reproduce, and promote that content on the marketplace and in related marketing, solely to operate and improve the service.

On the Basic (pay-per-listing) plan, each paid publish or renewal keeps a listing live for thirty days. When the paid period ends, the listing expires. Expired Basic listings are scheduled for permanent deletion after thirty days unless renewed or upgraded. Pro, Enterprise, and Premium subscription plans keep eligible listings live while the subscription remains active and in good standing, subject to plan limits and policy compliance.

BigTruckPage takes zero commission on marketplace sales. Buyers pay the listed price through Stripe; card processing fees apply on the seller's Stripe Connect payout (~2.9% + $0.30).

Basic pay-per-listing fees apply when you publish or renew without an active Pro, Enterprise, or Premium subscription: parts and services listings are $20 to publish and $15 to renew; truck listings are $75 to publish and $60 to renew, each for a thirty-day live period. Pro is $249 per month. Enterprise is $499 per month. Optional paid boosts include Featured Badge at $49.99 and Homepage Spotlight at $99.99, each for seven days.

Card payments are processed by Stripe, which charges the seller a processing fee (approximately 2.9% + $0.30 per transaction).

Subscriptions renew automatically until canceled. You may cancel at any time; cancellation takes effect at the end of the current billing period. Listing fees, boost purchases, and other one-time charges are generally non-refundable except where required by law or expressly stated at checkout.

When a buyer pays by card, Stripe processes a direct charge to the seller's connected Stripe account. BigTruckPage does not hold buyer funds, provide escrow, or release payment upon buyer confirmation. Payment terms, refunds, returns, and offline arrangements are between buyer and seller; use Messages to document agreements when needed.

Sellers and buyers may also discuss payment methods, pickup, freight, or other terms off-platform at their own risk. BTP is not responsible for off-platform payments or agreements.

Sellers coordinate pickup, local delivery, freight, and shipping directly with buyers. BigTruckPage does not ship items, arrange carriers, or guarantee delivery timelines. Any shipping quotes, freight estimates, or delivery commitments are solely between buyer and seller unless BTP explicitly states otherwise for its own inventory.

eBay listing export and import are available only to sellers on Enterprise or Premium plans. Connecting eBay requires OAuth authorization to your eBay seller account and is subject to eBay's terms, policies, and API limits. You are responsible for category mapping, pricing, fulfillment, and compliance on eBay. BTP is not responsible for eBay account actions, listing removals, or fees charged by eBay.

You agree not to use BigTruckPage to:

• Send spam, bulk unsolicited messages, or harassment.
• Scrape, crawl, or harvest data without our written permission.
• Attempt to bypass security, access controls, or rate limits.
• Commit fraud, misrepresent identity, or impersonate another person or business.
• Infringe intellectual property, privacy, or other third-party rights.

We may monitor, restrict, or remove messaging or inquiry content that violates these Terms or applicable law.

Listings and related content may be reviewed using automated tools, including Google Gemini models, and by human administrators. We may reject, suspend, or remove listings that appear to violate law, safety requirements, or marketplace policies, or that contain misleading, prohibited, or low-quality content. Moderation decisions do not create a warranty that every listing on the site is accurate or lawful.

BigTruckPage relies on third-party providers including Stripe (payments), Firebase (authentication and infrastructure), eBay (optional export), and Resend (transactional email). Your use of those services is governed by their respective terms and privacy policies. BTP is not liable for outages, errors, or actions taken by third-party providers beyond our reasonable control.

Buyers and sellers should first attempt to resolve order, quality, shipping, or payment disputes through the BigTruckPage Messages inbox. For card payments, buyers may also follow Stripe's chargeback and dispute process with their card issuer and the seller's connected account.

BTP is not an arbitrator for item condition, fitment, shipping performance, or buyer-seller payment disputes and does not guarantee outcomes between users.

These Terms are governed by the laws of the State of Missouri, without regard to conflict-of-law principles. Except where prohibited by law, you and BTP agree that any dispute arising from these Terms or the marketplace will be resolved by binding individual arbitration in Webster County, Missouri, under the rules of a recognized arbitration provider. You waive any right to participate in a class action against BTP to the fullest extent permitted by law.

We may suspend, restrict, or terminate your account or listings at any time for violation of these Terms, suspected fraud, legal requirements, or risk to users or the platform. You may close your account by contacting support; you remain responsible for outstanding obligations, open orders, and fees incurred before closure.

Disconnecting Stripe Connect or canceling a subscription does not automatically delete listings or messages. Lifecycle rules in Section 6 apply to expired or lapsed listings.

THE MARKETPLACE AND ALL RELATED SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. BTP DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT LISTINGS OR USER CONTENT ARE ACCURATE OR COMPLETE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, BTP AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM YOUR USE OF THE MARKETPLACE OR ANY TRANSACTION BETWEEN USERS.

BTP's total liability for any claim relating to the service is limited to the fees you paid to BTP in the twelve months before the claim, including subscription fees, Basic listing publish or renewal fees, and boost purchases. This cap does not include any platform fee on marketplace sales because BTP does not charge commission on buyer-seller transactions.

If you are a seller, you agree to indemnify, defend, and hold harmless BigTruckPage and its affiliates from claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your listings, your transactions with buyers, your breach of these Terms, or your violation of law or third-party rights.
